Execution of order passed under section 409
When in a case submitted to the High Court for the confirmation of a sentence of death, the Court of Session receives the order of confirmation or other order of the High Court thereon, it shall cause such order to be carried into effect by issuing a warrant or taking such other steps as may be necessary.
Why this exists
Death sentences passed by a Court of Session require mandatory confirmation by the High Court before they can be carried out. This provision ensures that once that confirmation (or a modified order) comes back, there is a clear, mandatory duty on the Court of Session to actually implement it without delay, closing the loop between the confirming High Court and the sentencing trial court. It corresponds to section 413 of the earlier CrPC.
