Section 454
Execution of sentence of death passed by High Court
When a sentence of death is passed by the High Court in appeal or in revision, the Court of Session shall, on receiving the order of the High Court, cause the sentence to be carried into effect by issuing a warrant.
Why this exists
Sometimes the High Court itself imposes a death sentence, for example by enhancing a lesser sentence on appeal or in revision, rather than merely confirming one passed below. This provision ensures there is still a clear mechanism, through the Court of Session, for actually implementing that sentence, since the High Court itself doesn't directly issue execution warrants. It reflects section 414 of the earlier CrPC.
