Terms of Service

Samvidhan (“the Service”, “we”, “us”) — comprising the website samvidhan.co.in, the exam-preparation tools and the developer API — is owned and operated by MARKJ Research and Analytics Solutions (“MARKJ”), India. These Terms of Service (“Terms”) are a legally binding agreement between you and MARKJ under the Indian Contract Act, 1872 and the Information Technology Act, 2000. By accessing or using the Service you accept these Terms; if you do not agree, do not use the Service.
1. Eligibility
You must be capable of forming a binding contract under Indian law. Users below 18 may use the Service only with the consent and supervision of a parent or legal guardian, who accepts these Terms on their behalf. Accounts are intended for users aged 13 and above.
2. Nature of the Service — educational only
The Service is an educational reference and study aid. It is not legal advice, does not create any advocate–client relationship, and must not be relied on for any legal proceeding, filing, compliance decision or dispute. For real matters consult a qualified advocate and verify all provisions against the official editions published by the Legislative Department, Ministry of Law and Justice, Government of India.
Two content layers. (a) Bare legal text is reproduced from open datasets of official consolidated editions and programmatically cross-checked against official sources; despite this, errors or lags relative to the current official text may exist. (b) Plain-language explainers, stories, ELI5 rewrites, case summaries, quiz questions, mock papers, equivalence maps and news articles are AI-assisted, clearly labelled, subject to automated validation and editorial review, and may nonetheless contain inaccuracies. Exam aspirants must cross-verify with standard texts and official syllabi.
3. Accounts and security
Authentication is provided through Clerk. You are responsible for maintaining the confidentiality of your account and for all activity under it. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms, abuse the infrastructure, attempt to circumvent rate limits or paywalls, scrape at scale, resell access, or use the Service for any unlawful purpose.
4. Free content, paid plans, payments and refunds
Reading the law — every provision, judgment summary, amendment, schedule and glossary entry — is free. Certain preparation features (“Prep Plus”) and the entire developer API are paid subscriptions. Prices, quotas and features are displayed before purchase and are inclusive or exclusive of GST as indicated at checkout.
Payments are processed by Razorpay Software Pvt. Ltd.; we never receive or store your card, UPI or bank details. Subscriptions renew automatically each billing period until cancelled from your account page. On cancellation, access continues until the end of the period already paid for; no pro-rata refunds for partial periods.
Refunds: if the paid Service was materially unavailable for a prolonged period, or a purchase was made in error and reported within 7 days without substantial use, write to the Grievance Officer (Section 12) — eligible refunds are processed to the original payment method within 7–10 working days.
5. Developer API — additional terms
API access requires an active paid plan and an API key. Keys are issued per account, must be kept secret, and must not be shared, sold or embedded in client-side/public code. Per-minute rate limits and per-day quotas for your plan are enforced technically and contractually. You may build and commercialise applications using the API on a Startup or higher plan. You may not: (a) redistribute or resell the raw dataset, in bulk or as a substantially similar competing API or database; (b) misrepresent AI-assisted content as officially issued government text; (c) use the API to train models designed to reproduce the Service. Attribution (“data via Samvidhan”) is appreciated. We may revoke keys used in breach.
6. Acceptable use
You agree not to: interfere with or disrupt the Service; probe or test vulnerabilities except through responsible disclosure to us; access data not intended for you; use automated means beyond documented API limits; upload malicious code; or use the Service to violate any applicable law, including the Information Technology Act, 2000 and rules thereunder.
7. Intellectual property
The text of the Constitution and statutes is in the public domain under Section 52(1)(q) of the Copyright Act, 1957. Everything else — the compilation, database structure, explainers, stories, questions, mock papers, articles, design, code and the Samvidhan name and marks — is the property of MARKJ or its licensors. You may quote reasonable extracts with attribution for education, research, review or news; systematic reproduction requires written permission.
8. Disclaimers and limitation of liability
The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied — including accuracy, completeness, currency, merchantability or fitness for a particular purpose. To the maximum extent permitted by law, MARKJ, its proprietors, employees and suppliers shall not be liable for any indirect, incidental, consequential, special or exemplary damages, or for loss of profits, data, reputation, exam outcomes or legal outcomes, arising from use of or reliance on the Service. Our aggregate liability for all claims in any twelve-month period is limited to the amounts you paid us in the three months preceding the claim (or ₹1,000 if you paid nothing).
9. Indemnity
You agree to indemnify and hold harmless MARKJ from claims, damages and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service or API, or your violation of any law or third-party right.
10. Suspension, termination and changes to the Service
We may modify, suspend or discontinue any part of the Service (including free features) at any time. If a paid feature is permanently discontinued, we will refund the unused portion of the current billing period. You may stop using the Service and delete your account at any time. Sections 7–9, 11 and 12 survive termination.
11. Governing law, dispute resolution and force majeure
These Terms are governed by the laws of India. Courts at Jaipur, Rajasthan shall have exclusive jurisdiction, subject to any mandatory consumer-protection forum available to you under the Consumer Protection Act, 2019. We are not liable for failure to perform caused by events beyond reasonable control (force majeure). If any provision is held unenforceable, the remainder continues in force; our failure to enforce a right is not a waiver.
12. Grievance redressal and contact
In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, complaints may be addressed to the Grievance Officer:

13. Updates to these Terms
We may revise these Terms; material changes will be flagged on this page with a new “Last updated” date and, for account holders, by email or in-product notice. Continued use after the effective date constitutes acceptance.
