Reasons to be recorded
A Sessions Judge or Magistrate making an order under section 448, section 449, section 450 or section 451 shall record his reasons for making it. A.—Death sentences
Why this exists
Requiring recorded reasons ensures transparency and accountability whenever a case is moved between courts or judges, preventing arbitrary or unexplained transfers and allowing higher courts to review whether the transfer power was properly exercised if ever challenged. It reflects section 412 of the earlier CrPC.
