Why this exists

This section is the backbone of the criminal appeal structure, ensuring every convicted person has a clear, defined route to challenge their conviction, with the appellate forum matched to the seriousness of the sentence and the level of the trial court. The strict six-month timeline for appeals in serious sexual-offence cases reflects a deliberate policy push, following the 2013 and later criminal law amendments, to speed up justice in such cases for victims and the accused alike. It continues, with this added timeline, section 374 of the CrPC, 1973.

  • Myth: Every appeal automatically goes to the Supreme Court.
