Bharatiya Nagarik Suraksha Sanhita, 2023
Section 405
Judgment when to be translated
The original judgment shall be filed with the record of the proceedings and where the original is recorded in a language different from that of the Court, and if either party so requires, a translation thereof into the language of the Court shall be added to such record.
Why this exists
India has many languages, and judgments are sometimes recorded in a local or vernacular language different from the formal language of the court or of appellate courts. This provision ensures both the parties and any reviewing court can access an accurate translation when needed, so language differences don't become a barrier to understanding or challenging a decision. It carries forward section 364 of the CrPC, 1973.
