Section 404

Copy of judgment to be given to accused and other persons

Why this exists

The right to a copy of the judgment is central to the right to appeal and to basic fairness -- a convicted person cannot meaningfully challenge a decision they cannot read. Making death-sentence copies automatic and immediate reflects the extreme seriousness of capital cases, where delay in getting the judgment could eat into the limited time available to appeal for one's life. This provision continues, largely unchanged, section 363 of the CrPC, 1973.

Common misconceptions
  • Myth: Only the accused can ever get a copy of a court judgment.
    Fact: Any person affected by the judgment or order can apply for a copy, and even unaffected persons may get one under High Court rules, though fees may apply for non-appealable cases.
