Bharatiya Nagarik Suraksha Sanhita, 2023
Section 406
Court of Session to send copy of finding and sentence to District Magistrate
In cases tried by the Court of Session or a Chief Judicial Magistrate, the Court or such Magistrate, as the case may be, shall forward a copy of its or his finding and sentence (if any) to the District Magistrate within whose local jurisdiction the trial was held.
Why this exists
This provision keeps the District Magistrate, who has broader administrative and law-and-order responsibilities in the district, informed about the outcomes of significant criminal trials happening within their jurisdiction. It supports coordination between the judiciary and district administration, particularly relevant for matters like custody, jail administration, or public order that the District Magistrate may need to track. It continues section 365 of the CrPC, 1973 unchanged.
