Indian Penal Code, 1860
Section 483
repealedCounterfeiting a property mark used by another
Whoever counterfeits any property mark used by any other person shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
Why this exists
This section protects a person's established ownership mark from being copied outright by others. Where section 482 punishes using a false mark generally, this one specifically targets the act of copying or imitating a mark that someone else has already been using to identify their own property. The IPC was repealed on 1 July 2024 and replaced by the Bharatiya Nyaya Sanhita, 2023, which now governs these offences.
