Indian Penal Code, 1860
Section 454
repealedLurking house-trespass or house-breaking in order to commit offence punishable with imprisonment
Whoever commits lurking house-trespass or house-breaking, in order to the committing of any offence punishable with imprisonment, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine;
Why this exists
This section raises the punishment beyond the baseline in section 453 when the concealed or forceful trespass is a means to some other imprisonable offence, reflecting that the intruder's purpose makes the intrusion more dangerous than mere trespass or break-in without a further criminal goal.
