Section 394
repealedVoluntarily causing hurt in committing robbery
If any person, in committing or in attempting to commit robbery, voluntarily causes hurt, such person, and any other person jointly concerned in committing or attempting to commit such robbery, shall be punished with imprisonment for life, or with rigorous imprisonment for a term which may extend to ten years, and shall also be liable to fine.
Why this exists
This section raises the punishment for robbery when actual injury is caused during the crime, and importantly extends that heavier liability to everyone jointly involved in the robbery, not just the individual who directly caused the hurt. This reflects the law's approach to group crime, holding all participants accountable for the escalation into violence that happens during a robbery they jointly planned or carried out. A similarly structured provision for injury caused during robbery continues under the Bharatiya Nyaya Sanhita, 2023, which replaced the Indian Penal Code in 2024.
