Section 354B
repealedAssault or use of criminal force to woman with intent to disrobe
Any man who assaults or uses criminal force to any woman or abets such act with the intention of disrobing1 or compelling her to be naked, shall be punished with imprisonment of either description for a term which shall not be less than three years but which may extend to seven years, and shall also be liable to fine.
Why this exists
This provision was introduced in 2013 after the Justice Verma Committee's recommendations, responding to the recognised need for a specific, serious offence targeting the particularly degrading and traumatic act of forcibly stripping a woman, a crime sometimes used to publicly humiliate women during personal disputes, mob violence, or communal incidents. After 2024, this offence corresponds to Section 76 of the Bharatiya Nyaya Sanhita.
Common misconceptions
- Myth: This section only applies to strangers attacking a woman.
Fact: It applies regardless of the relationship between the accused and the victim, including in family disputes, communal violence, or mob situations.
