Indian Penal Code, 1860
Section 343
repealedWrongful confinement for three or more days
Whoever wrongfully confines any person for three days or more, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
Why this exists
The longer someone is unlawfully trapped, the greater the harm to their liberty and wellbeing, so the law increases the punishment as the duration of confinement rises. This section marks the first tier of enhanced punishment based on the length of confinement.
Common misconceptions
- Myth: The punishment for confinement is always the same regardless of how long it lasts.
Fact: The law increases the punishment in stages as confinement lasts longer, three days or more triggers this heavier section, ten days or more triggers an even heavier one.
