Section 337
repealedCausing hurt by act endangering life or personal safety of others
Whoever causes hurt to any person by doing any act so rashly or negligently as to endanger human life, or the personal safety of others, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to five hundred rupees, or with both.
Why this exists
This section is the natural next step after Section 336: when reckless conduct actually results in injury, rather than just risk, the punishment is somewhat higher. It commonly applies to careless driving, mishandling of machinery, or negligent handling of fire or chemicals that ends up hurting someone.
How courts read it
Courts applying this section, including in road-accident cases, have generally looked at whether the accused's conduct showed a clear disregard for the safety of others, distinguishing genuine accidents from rash or negligent behaviour that foreseeably could cause harm.
Common misconceptions
- Myth: This only applies to traffic accidents.
Fact: It applies to any reckless or negligent act causing hurt, including mishandling machinery, fire, or dangerous substances, not just vehicle accidents.
