Section 332
repealedVoluntarily causing hurt to deter public servant from his duty
Whoever voluntarily causes hurt to any person being a public servant in the discharge of his duty as such public servant, or with intent to prevent or deter that person or any other public servant from discharging his duty as such public servant, or in consequence of anything done or attempted to be done by that person in the lawful discharge of his duty as such public servant, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
Why this exists
Government work only functions if officials can carry out their duties without being physically attacked or intimidated. This section protects tax officers, police, revenue staff and other public servants from violence meant to obstruct or punish them for lawful official action. After 2024, this offence is covered under Section 121(1) of the Bharatiya Nyaya Sanhita.
Common misconceptions
- Myth: This only applies to police officers.
Fact: It covers any public servant, such as inspectors, revenue officers, and other government staff, while they are performing official duties.
