Indian Penal Code, 1860
Section 216B
repealedDefinition of harbour in sections 212, 216 and 216A.
Repealed by the Indian Penal Code (Amendment) Act, 1942 (8 of 1942), S. 3.
Why this exists
Section 216B originally explained what 'harbour' meant for the purposes of sections 212, 216, and 216A, which deal with helping offenders escape punishment. Parliament later restructured these provisions, and the separate definition section was removed in 1942 because the definition was folded into or replaced by other provisions.
Common misconceptions
- Myth: Section 216B still defines 'harbour' in Indian law today.
Fact: It was repealed in 1942 and has no legal effect; any definition of 'harbour' now comes from other applicable provisions or general legal interpretation.
