Why this exists
Section 163 was originally part of a group of IPC provisions (Sections 161–165A) dealing with bribery and corruption by public servants. In 1988, Parliament decided to consolidate and modernize all anti-corruption law into one dedicated statute, the Prevention of Corruption Act, 1988. As part of this reform, several overlapping IPC sections on bribery, including Section 163, were repealed and their subject matter was re-enacted, often in an updated form, within the new Act.
Common misconceptions
- Myth: Section 163 of the IPC can still be used to prosecute someone for bribery today.
Fact: It was repealed in 1988; bribery-related offences are now prosecuted under the Prevention of Corruption Act, 1988.
