Indian Penal Code, 1860

Section 15

repealed

British India

Why this exists

The Indian Penal Code, 1860, originally contained definitions tied to British colonial administrative divisions, such as 'British India,' which distinguished territories under direct British Crown control from princely states. As India's constitutional and administrative structure evolved, particularly with the Government of India Act, 1935, these colonial-era territorial definitions became outdated. The Adaptation of Orders 1937 removed such provisions to align the Code with the new administrative framework introduced by that Act.

Common misconceptions
  • Myth: Section 15 still defines what counts as 'India' under criminal law today.
Fact: It was repealed in 1937 and has no legal effect; modern definitions come from other laws and the Constitution.
