Why this exists
Section 138A was originally part of a set of provisions extending IPC offences to members of the Indian Marine Service, similar to how the Code applied special rules to the armed forces. As administrative structures changed and marine personnel came to be governed by their own specific service laws and regulations, this provision became redundant. The Amending Act, 1934 was a broad clean-up law that removed several outdated or overlapping provisions from the IPC, and this section was one of them.
Common misconceptions
