Bharatiya Nagarik Suraksha Sanhita, 2023

Section 93

Provisions of this Chapter generally applicable to summons and warrants of arrest

Why this exists

Criminal procedure codes often create summons and warrants in many different sections (for witnesses, accused persons, property production, etc.). Rather than repeating detailed rules on service and execution every time, the law places one detailed set of rules in this chapter and then, through a section like this, extends those same rules generally to all summons and warrants issued anywhere in the Sanhita. This drafting technique keeps the law shorter and consistent. It continues a similar structure used in the earlier Code of Criminal Procedure, 1973.

Common misconceptions
  • Myth: This section creates a brand new type of summons or warrant.
Fact: It does not create anything new — it only extends the existing rules on issuing, serving, and executing summons and warrants to apply generally across the whole Sanhita.
