Bharatiya Nagarik Suraksha Sanhita, 2023
Section 476
Concurrent power of Central Government in case of death sentences
The powers conferred by sections 473 and 474 upon the State Government may, in the case of sentences of death, also be exercised by the Central Government.
Why this exists
Death sentences carry national significance and can involve central agencies or laws. This section ensures the Central Government isn't excluded from exercising clemency powers in these most serious cases, alongside the State Government, rather than leaving such decisions solely to the state.
