Bharatiya Nagarik Suraksha Sanhita, 2023
Section 459
Direction of warrant for execution
Every warrant for the execution of a sentence of imprisonment shall be directed to the officer in charge of the jail or other place in which the prisoner is, or is to be, confined.
Why this exists
For a warrant to have legal effect and be properly acted upon, it must clearly identify who is responsible for receiving and enforcing it. This provision fixes the correct recipient, the officer in charge of the relevant place of confinement, ensuring there's no confusion or gap in authority when a prisoner is delivered. It reflects section 419 of the earlier CrPC.
