Order to pay compensation

Why this exists

Criminal punishment alone does not repair the harm suffered by victims. This section lets the criminal court itself direct some relief to victims — whether through the offender's fine or a separate compensation order — recognising that justice for the victim, not just punishment of the offender, is a core part of the criminal process.

How courts read it

The Supreme Court has held that courts must apply their mind and consider awarding compensation to victims in every case where a sentence is passed, treating this as a mandatory duty rather than a power to be exercised only occasionally; a failure to even consider compensation can itself be a ground for appeal.

  • Myth: Compensation to victims only happens if a separate civil lawsuit is filed.
    Fact: This section lets the same criminal court order compensation directly, as part of or alongside the sentence, without requiring a separate civil suit.
