Section 392

Judgment

Why this exists

A judgment is the final, decisive act of a criminal trial, and the law insists it be delivered transparently, promptly, and in a way the accused can actually understand — in open court, within a fixed time limit, properly recorded and signed, and made available to the parties. These formalities protect against secret, delayed, or garbled verdicts, while also allowing the court to move forward practically even when someone chooses not to attend.

Common misconceptions
  • Myth: A judgment becomes invalid if the accused's lawyer happens to be absent when it is delivered.
Fact: This section specifically says a judgment is not invalidated just because a party or their advocate was absent when it was pronounced.
