Section 335

Record of evidence in absence of accused

Why this exists

This provision, from Section 299 of the old CrPC, prevents an absconding accused from indefinitely defeating justice simply by staying hidden until key witnesses die or disappear. It lets the court preserve evidence in advance, but only allows its later use under specific conditions ensuring the witness genuinely cannot testify again by the time the accused is caught.
