Bharatiya Nagarik Suraksha Sanhita, 2023
Section 264
Conviction on plea of guilty
If the accused pleads guilty, the Magistrate shall record the plea and may, in his discretion, convict him thereon.
Why this exists
Like its Sessions Court counterpart, this saves time for straightforward admissions of guilt in Magistrate-tried warrant cases, while leaving the decision to convict on the plea itself to the Magistrate's judgment rather than making it automatic. It mirrors section 241 of the earlier Code of Criminal Procedure.
