Section 260

Procedure in cases instituted under sub-section (2) of section 222

Why this exists

Section 222(2) lets certain serious complaints go straight to the Court of Session without passing through a Magistrate first; this section makes sure such trials still follow a fair, structured warrant-case procedure and protects the alleged victim's privacy through in-camera trials when needed. Its compensation mechanism deters people from making false and unreasonable accusations of serious crimes, while shielding high constitutional offices from being forced to pay such compensation. It mirrors section 237 of the earlier Code of Criminal Procedure.
