Definitions

Why this exists

Every procedural code needs a common vocabulary so police, lawyers, judges, and citizens interpret the same words the same way. This Section carries forward and updates definitions from the old Code of Criminal Procedure, 1973, while adding new terms like 'audio-video electronic' and 'electronic communication' to reflect modern technology such as video conferencing and digital evidence, which the 2023 reforms specifically wanted to enable and regulate.

Common misconceptions
  • Myth: A 'complaint' includes police reports too.
    Fact: The law says a complaint specifically excludes police reports, except when police report only a non-cognizable offence after investigation, in which case it is deemed a complaint.
  • Myth: Any place can be called a 'police station' if police work there.
    Fact: Only locations officially declared by the State Government count as police stations under this definition.
  • Myth: 'Victim' only refers to the injured person themselves.
    Fact: The definition also includes the victim's guardian or legal heir, extending certain rights to them too.
