Section 4
Punishments
—The punishments to which offenders are liable under the provisions of this Sanhita are—
(a) Death;
(b) Imprisonment for life;
(c) Imprisonment, which is of two descriptions, namely:—
(1) Rigorous, that is, with hard labour;
(2) Simple;
(d) Forfeiture of property;
(e) Fine;
(f) Community Service.
Why this exists
This provision replaces Section 53 of the old Indian Penal Code, 1860, keeping the traditional hierarchy of punishments largely intact while modernising it. The Bharatiya Nyaya Sanhita, 2023 added 'Community Service' as a new, reformative punishment option, reflecting a shift toward restorative justice for minor offences and reducing overcrowding in prisons, alongside the older colonial-era punishments of death, life imprisonment, imprisonment (rigorous or simple), forfeiture of property, and fine.
How courts read it
Under the predecessor IPC provision, courts developed extensive jurisprudence on when death or life imprisonment applies, most notably the 'rarest of rare' doctrine from Bachan Singh v. State of Punjab (1980) for imposing death sentences, and rulings clarifying that life imprisonment means imprisonment for the remainder of one's natural life (Union of India v. V. Sriharan, 2015) unless remitted by appropriate government action. Since 'Community Service' is newly introduced, courts and legislatures are still developing rules on which specific offences attract it and how it should be supervised; no settled body of case law exists yet.
Common misconceptions
- Myth: Community service is a lenient 'let-off' with no real punishment.
Fact: Community service is a formal legal punishment ordered by a court and must be completed as directed; failing to comply can lead to other penalties. - Myth: Life imprisonment always means a fixed number of years, like 14 or 20.
Fact: Courts have clarified that life imprisonment generally means imprisonment for the remainder of the convict's natural life, unless the government exercises its power to remit or commute the sentence.
