Section 314

Dishonest misappropriation of property

Why this exists

This section covers situations where property was not dishonestly taken from someone's possession (which would be theft) but ends up being wrongly kept or used by a person — such as finding lost property, or property received by mistake — and only later being dishonestly appropriated. It balances protecting honest finders who make reasonable efforts to return lost property against punishing those who simply keep what isn't theirs.

Common misconceptions
  • Myth: If you find lost property, keeping it is only wrong if you know exactly who the owner is from the start.
    Fact: You can still be guilty if you fail to take reasonable steps to discover the owner, or keep the property once you learn or could easily learn who the owner is, even if you didn't know at first.
