Section 308

Extortion

Why this exists

Extortion criminalises using fear and intimidation, rather than physical force alone, to dishonestly obtain property or valuable documents. The graded punishments — depending on whether the fear was of ordinary injury, death or grievous hurt, or a serious criminal accusation — reflect how much more dangerous and coercive some threats are than others.

Common misconceptions
  • Myth: Extortion requires physical force, like robbery.
Fact: Extortion works through fear and intimidation to dishonestly induce someone to hand over property; it does not require physical force or even the extortionist being physically present, unlike robbery.
