Section 285
Danger or obstruction in public way or line of navigation
Whoever, by doing any act, or by omitting to take order with any property in his possession or under his charge, causes danger, obstruction or injury to any person in any public way or public line of navigation, shall be punished with fine which may extend to five thousand rupees.
Why this exists
Public roads and waterways need to remain safe and passable for everyone; carelessly leaving obstacles, materials, or unmanaged property in these shared spaces can cause accidents even without any intention to harm anyone. This section, continuing the old IPC Section 283, provides a lighter, fine-only penalty for this kind of obstruction or hazard.
Common misconceptions
- Myth: This offence requires deliberate intent to cause an obstruction.
Fact: It also covers careless failure to properly manage property under one's charge, not only deliberate obstruction.
