Prohibition of fictitious stamps

Why this exists

This provision protects the integrity of the postal system, which historically relied on government-issued stamps as proof that postage had been paid. Fake stamps could cheat postal revenue and undermine public trust in mail delivery. The law traces back to colonial-era postal and stamp offences in the Indian Penal Code, carried forward with modernized numbering into the Bharatiya Nyaya Sanhita, 2023, though the fine amount has remained deliberately modest since the harm is usually financial and minor rather than violent or serious.

Common misconceptions
  • Myth: Making a fake postage stamp is a serious crime with jail time.
    Fact: Under this specific section, the only punishment is a fine up to Rs. 200; there is no imprisonment prescribed.
  • Myth: You have to actually use a fake stamp to be punished.
    Fact: Simply possessing a fake stamp without a lawful excuse, or possessing tools to make one, is enough to be an offence.
